State Government shall appoint a person who is qualified to be appointed as a Judge of a High Court, or is holding or has held a judicial office not lower in rank than that of District Judge, to be the President of the Maharashtra State Co-operative Appellate Court.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ba5ba7d e-con-full e-flex e-con e-child\" data-id=\"ba5ba7d\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d1d4b29 elementor-widget elementor-widget-text-editor\" data-id=\"d1d4b29\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(2) Each of the other members of the Appellate Court to be appointed by the State Government shall be a person.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41ca445 elementor-widget elementor-widget-text-editor\" data-id=\"41ca445\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul style=\"margin-bottom: 0px;\">\n \t<li style=\"margin-bottom: 5px;\">(a) who possesses any qualification laid down in sub-rule (J), or<\/li>\n \t<li style=\"margin-bottom: 5px;\">(b) who has held office not lower in rank than that of Joint Registrar or Cooperative Societies for <span class=\"tooltip\" style=\"font-size: 95%; line-height: 0;\"><sup class=\"tooltip-number\" style=\"top: 0em;\">2<\/sup>\n<span class=\"tooltiptext\">Subs, by G.N. of 7-8-1981.\n<\/span>\n<\/span> [not less than one year].<\/li>\n \t<li style=\"margin-bottom: 5px;\">(c) who is enrolled as an Advocate, or holds a degree or other qualification in law of any University established by law or of any other authority which entitles him to be enrolled as an Advocate, and either (0 has held office not lower in rank than that of Deputy Secretary to Government for no less than three years, or (ifl in the opinion of the State Government, possesses good knowledge and experience of co-operative law and practice or is closely associated with the co-operative movement.\nSo far as practicable, at least one of the other members of the Appellate Court shall be a person who is holding or has held an ofiice not lower in rank than that of Joint Registrar as aforesaid.<\/li>\n<\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4631916 e-con-full e-flex e-con e-child\" data-id=\"4631916\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-1e41eb5 elementor-widget elementor-widget-text-editor\" data-id=\"1e41eb5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(3) Appointments of persons who possess qualifications other than those of holding or having held a judicial or other qualifying of fice under Government as President or other members of the Appellate Court shall be made by the State Government, after consultation with the Advocate General for the State\n<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-57af019 e-con-full e-flex e-con e-child\" data-id=\"57af019\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-84de814 elementor-widget elementor-widget-text-editor\" data-id=\"84de814\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(4) No person shall hold or continue to hold the office of the President after he attains the age of sixty-five years and of any other member of the Appellate Court after he attains the age of sixty-two years.\n<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-aee3756 e-con-full e-flex e-con e-child\" data-id=\"aee3756\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ef7b794 elementor-widget elementor-widget-text-editor\" data-id=\"ef7b794\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(5) If the President or any other member of the Appellate Court is in Government service at the time of his appointment, his pay, allowances and other conditions of service shall continue to be governed by the service conditions rules applicable to him before such appointment, and if he is a direct recruit, his pay, allowances and other conditions of service shall be governed by the Bombay Civil Services Rules and other rules made by the State Government from time to time.\n<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-d52275f e-con-full e-flex e-con e-child\" data-id=\"d52275f\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6ea8b5b elementor-widget elementor-widget-text-editor\" data-id=\"6ea8b5b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(6) Subject to sub-rule (4) and save as otherwise specified by the State Government in any case, the President and any other member of the Appellate Court shall hold office for a period of three years in the first instance, and thereafter his term of office may be extended by the State Government, from time to time, for such period as it may deem fit.\n<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-007f831 e-con-full e-flex e-con e-child\" data-id=\"007f831\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-854907d elementor-widget elementor-widget-text-editor\" data-id=\"854907d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(7) In the event of the occurrence of any vacancy in the office of the President of the Appellate Court, the senior-most member having judicial experience shall act as President.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ceaa57b e-con-full e-flex e-con e-child\" data-id=\"ceaa57b\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c61ef60 elementor-widget elementor-widget-text-editor\" data-id=\"c61ef60\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(8) The Headquarters of the Appellate Court shall be at such place as may be notified by the State Government in the Official Gazette.\n<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-a781e8b e-con-full e-flex e-con e-child\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(2) When such an appeal is presented by an agent, it shall be accompanied by letter of authority of the appellant appointing him as such.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-464cba6 e-con-full e-flex e-con e-child\" data-id=\"464cba6\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-519f6f2 elementor-widget elementor-widget-text-editor\" data-id=\"519f6f2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(3) Every appeal shall be accompanied by a certified copy of the order against which the appeal is preferred.\n<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c2be518 e-con-full e-flex e-con e-child\" data-id=\"c2be518\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-0fb72bf elementor-widget elementor-widget-text-editor\" data-id=\"0fb72bf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(4) Every appeal shall:-<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-15350fa elementor-widget elementor-widget-text-editor\" data-id=\"15350fa\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul style=\"margin-bottom: 0px;\">\n \t<li>(i) be either type written or hand written in ink legibly;<\/li>\n \t<li>(ii) specify the name and the address of the appellant and also the name and address of the opponent, as the case may be;<\/li>\n\n\n<li>(ii) specify the name and the address of the appellant and also the name and address of the opponent, as the case may be;<\/li>\n\n\n<li>(iii) state by whom the order against which the appeal is preferred was made;<\/li>\n<li>(iv) clearly state the grounds on which the appeal is made;<\/li>\n\n<li>(v) state precisely the relief which the appellant claims; and<\/li>\n\n<li>(vi) give the date of the order appealed against.<\/li>\n\n<\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-42e9903 e-con-full e-flex e-con e-child\" data-id=\"42e9903\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-a1ab4ba elementor-widget elementor-widget-text-editor\" data-id=\"a1ab4ba\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(5) On receipt of the appeal, the appellate authority shall endorse on it the date of its receipt by it. The appellate authority shall, as soon as possible, examine it and satisfy itself that:-<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-54bf5f6 elementor-widget elementor-widget-text-editor\" data-id=\"54bf5f6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul style=\"margin-bottom: 0px;\">\n \t<li>(i) the person presenting it has the authority to do so;<\/li>\n \t<li>(ii) that it is made within the prescribed time limit; and<\/li>\n \t<li>(iii) that it conforms to all the provisions of the Act and these rules.<\/li>\n \t\n<\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e4ffe19 e-con-full e-flex e-con e-child\" data-id=\"e4ffe19\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-e18e244 elementor-widget elementor-widget-text-editor\" data-id=\"e18e244\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(6) If the appellate authority finds that the appeal presented does not conform to any of the said provisions, it shall make a note on the appeal to that effect and may call upon the appellant or his agent to remedy the defects within a period of seven days of the receipt of the notice to do so or in case the appeal has not been presented within the prescribed time limit to show cause within the said period of seven days why it should not be dismissed as time-barred by the appellate authority.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-084ce8c e-con-full e-flex e-con e-child\" data-id=\"084ce8c\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7091e5f elementor-widget elementor-widget-text-editor\" data-id=\"7091e5f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(7) If the defect is remedied or the cause shown by the appellant or his agent satisfies the appellate authority, the appellate authority may proceed to consider the appeal.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-84b6f28 e-con-full e-flex e-con e-child\" data-id=\"84b6f28\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-45e8ba7 elementor-widget elementor-widget-text-editor\" data-id=\"45e8ba7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">(8) If the appellant or his agent fails to remedy the defects or to show cause to the satisfaction of the appellate authority within the said period, the appellate authority may, if the appeal is not presented within the time limit, dismiss the appeal as time-barred.
