REDRESSAL OF MEMBERS COMPAINTS<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-34dc4e5 elementor-widget elementor-widget-text-editor\" data-id=\"34dc4e5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom:0px;\">(Bye Law No 172, 173 and 174)<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e77eef1 e-con-full e-flex e-con e-child\" data-id=\"e77eef1\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-44947be elementor-widget elementor-widget-heading\" data-id=\"44947be\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 172. Complaint application to be submitted to the Society <\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f3adc07 elementor-widget elementor-widget-text-editor\" data-id=\"f3adc07\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">Member\/Members shall submit their complaint application to any of the Office bearers of the Society, in writing, giving thereby the details of the complaint.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-06bbb2b elementor-widget elementor-widget-heading\" data-id=\"06bbb2b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 173. Committee's action on the Complaint Application <\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c12d9b elementor-widget elementor-widget-text-editor\" data-id=\"8c12d9b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom:0px;\">After receipt of such, complaint application, the committee shall take decision thereof, in the immediate next Managing Committee meeting. Such decision shall be communicated to the concerned Member, within 15 days thereafter.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b5c0731 elementor-widget elementor-widget-heading\" data-id=\"b5c0731\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174. If the action is not taken within stipulated period by the society then to whom the complaint to be made <\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d7b0568 elementor-widget elementor-widget-text-editor\" data-id=\"d7b0568\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom:0px;\">If the Member\/Members are not satisfied by the decision of the Committee, or does not receive any communication from the committee within 15 days, the complainant Member may approach below mentioned Competent Authority.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4df83ab e-con-full e-flex e-con e-child\" data-id=\"4df83ab\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d14a078 elementor-widget elementor-widget-heading\" data-id=\"d14a078\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174(a) THE REGISTRAR<\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3f663a7 elementor-widget elementor-widget-text-editor\" data-id=\"3f663a7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol class=\"word\"><li>Complaints to be made to the Registrar. Matters pertaining to following issues :-<\/li><li>Registration of Society on Misrepresentation<\/li><li>Non-issuance of the Share Certificates<\/li><li>Refusal of Membership<\/li><li>Non registration of Nomination by the Society<\/li><li>Non Occupancy charges<\/li><li>Demand of excess premium for transfers<\/li><li>Non supply of the copies of record and documents<\/li><li>Tampering, suppression and destruction of the records of the Society<\/li><li>Non acceptance of the cheques or any other correspondence by the committee<\/li><li>Non maintenance or incomplete maintenance of records and books of the Society<\/li><li>Non preparation of the annual accounts\/reports, within the prescribed period<\/li><li>Misappropriation\/ Misapplication of the Funds of the Society<\/li><li>Defaulter\/Disqualified Member on the committee<\/li><li>Investment of Funds without prior permission of G.B.M.<\/li><li>Reconciliation of Accounts<\/li><li>Audit, Audit Rectification reports<\/li><li>Non conducting of election before expiry of the term of the Committee as per law<\/li><li>Rejection of Nomination<\/li><li>Non convening of General Body meetings within prescribed period on or before 30th September of each year<\/li><li>Non calling of Managing Committee meeting as prescribed in Bye-laws<\/li><li>Resignation by the Committee<\/li><li>Any other like matters which falls within jurisdiction of the Registrar<\/li><li>Non filling of Returns and statements<\/li><li>Classification as Active and Non-Active Members<\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8552024 elementor-widget elementor-widget-heading\" data-id=\"8552024\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174(b) CO-OPERATIVE COURT<\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76f361a elementor-widget elementor-widget-text-editor\" data-id=\"76f361a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">Disputes between the Members and\/or the Members and Society, which falls under Section 91 of the MCS Act 1960 such as:-<br \/>Disputes pertaining to:-<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-809b1b5 elementor-widget elementor-widget-text-editor\" data-id=\"809b1b5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol class=\"word\"><li>Resolutions of the Managing Committee and General Body<\/li><li>The elections of the Managing Committee, except the Rejection of Nominations, as provided under section 152-A of the MCS Act 1960<\/li><li>Repairs, including Major Repairs, Internal Repairs, Leakages<\/li><li>Parking<\/li><li>Allotment of Flats\/Plots<\/li><li>Escalation of Construction Cost<\/li><li>Appointment of Developer\/Contractor, Architect<\/li><li>Unequal water-supply<\/li><li>Excess recovery of dues from the Members<\/li><li>Any other, like, disputes which fall within jurisdiction of the Co-operative Court<\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2cfcdcf elementor-widget elementor-widget-heading\" data-id=\"2cfcdcf\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174(c) CIVIL COURT<\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f0bdf13 elementor-widget elementor-widget-text-editor\" data-id=\"f0bdf13\" conditions of the Agreement, by and between the Builder\/developer, (specific performance)<\/li><li>Substandard Constructions<\/li><li>Conveyance Deed in favour of the Society,<\/li><li>Escalation of construction cost,<\/li><li>Any other, like, disputes which fall within jurisdiction of the Civil Court.<\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element constructions\/additions\/alterations, made by builder\/Member\/ occupant of the flat<\/li><li>Inadequate Water supply to the Society and Members<\/li><li>Change of use by the Members\/occupants<\/li><li>Building&#8217;s structural problems<\/li><li>Any other, like, matters which fall within jurisdiction of the Corporation\/local authority for eg. Property tax, streetlights, garbage, and other civil amenities etc<\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8536d3f elementor-widget elementor-widget-heading\" data-id=\"8536d3f\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174(e) POLICE\n<\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b00e65 elementor-widget elementor-widget-text-editor\" data-id=\"4b00e65\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom:0px;\">Matters pertaining to:-<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-64d87e1 elementor-widget elementor-widget-text-editor\" data-id=\"64d87e1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol class=\"word\">\n \t<li>Nuisance carried by the Unauthorised user of the Flat \/ Shop \/ Parking slot \/ Open space in the Society, by the Members, builder, occupants or any other persons,<\/li>\n \t<li>Threatening \/ Assault by or to the Members of the Society and official body.\n<\/li>\n \t<li>Any other like matters which fall within jurisdiction of the Police.\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9a8eae elementor-widget elementor-widget-heading\" data-id=\"f9a8eae\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174(f) GENERAL BODY MEETING\n<\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6c932fe elementor-widget elementor-widget-text-editor\" data-id=\"6c932fe\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">Matters pertaining to:-<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e2b70ac elementor-widget elementor-widget-text-editor\" data-id=\"e2b70ac\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol class=\"word\"><li>Non maintenance of the property of the Society by the Managing Committee<\/li><li>Non display of Board of the name of the Society<\/li><li>Levy of excess Fine, by the Managing Committee for act of the Member which is in violation of the Bye-laws<\/li><li>Not allowing the authenticated use of the available open spaces of the Society, by the Managing Committee<\/li><li>Non Insuring the property of the Society, by the Managing Committee<\/li><li>Appointment of Architect<\/li><li>All other like matters which fall within jurisdiction of the General Body<\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8493067 elementor-widget elementor-widget-heading\" data-id=\"8493067\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h6 class=\"elementor-heading-title elementor-size-default\">Bye Law No 174(g) FEDERATION -DISTRICT \/ STATE\n<\/h6>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9e439a elementor-widget elementor-widget-text-editor\" data-id=\"f9e439a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"margin-bottom: 0px;\">Matters pertaining to:-<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-09759de elementor-widget elementor-widget-text-editor\" data-id=\"09759de\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol class=\"word\"><li>Not allowing of the entry to the Secretary of the Society, by the Member<\/li><li>Non acceptance of any communication by the Member\/ Managing Committee<\/li><li>Convening Special General Body Meeting provided under the Bye-law no. 96 and Managing Committee meeting provided under Bye-law no. 132.
