housing society was changed when the MCS act was amended and came into force on 9\/3\/2019.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba4f67d elementor-widget elementor-widget-text-editor\" data-id=\"ba4f67d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tOld definition of associate member before amendment of MCS act. Was as follows &#8211;\nAs per Bye law 3(xxiv)(b) &#8220;Associate Member&#8221; means a member.<strong>who holds the right, title and interest in the property individually or jointly with other, but whose name does not stand first in Share Certificate<\/strong>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-88c1a4e elementor-widget elementor-widget-text-editor\" data-id=\"88c1a4e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<span style=\"font-weight: 400;\">Associate member definition, as per amended MCS act W.E.F 9\/3\/2019 <\/span><span style=\"font-weight: 400;\">Section 154B-1 (18) (a)\u00a0 \u201cAssociate\u00a0 Member\u201d\u00a0 means\u00a0 husband,\u00a0 wife,\u00a0 father,\u00a0 mother, brother,\u00a0 sister,\u00a0 son,\u00a0 daughter,\u00a0 son-in-law, daughter-in-law,\u00a0 nephew, niece\u00a0 a\u00a0 person\u00a0 duly\u00a0 admitted\u00a0 to\u00a0 Membership\u00a0 of\u00a0 a\u00a0 housing\u00a0 society on\u00a0 written\u00a0 recommendation\u00a0 of\u00a0 a\u00a0 Member\u00a0 to\u00a0 exercise\u00a0 his\u00a0 rights\u00a0 and duties\u00a0 with\u00a0 his\u00a0 written\u00a0 prior\u00a0 consent\u00a0 and\u00a0<\/span><b>whose\u00a0 name\u00a0 does\u00a0 not stand\u00a0 in\u00a0 the\u00a0 share\u00a0 certificate<\/b>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-599b01f elementor-widget elementor-widget-text-editor\" data-id=\"599b01f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tAfter the amendment new forms\/bye laws\/rules should have been notified but it got delayed due to various reasons. Now we have amended the act but old forms 5 and 10A for associate membership. Form 5 is an application by the associate member to enable him\/her to attend AGM\/SGM in the absence of the original member. These documents include a copy of the Act, rules, bye-laws, the last audited annual balance sheet, the profit and loss account, a list of the members of the Committee, a register of members, minutes of general meetings, minutes of Committee meetings, and those portions of the books and records where their transactions with the society have been recorded.\n<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-92c94f4 elementor-widget elementor-widget-text-editor\" data-id=\"92c94f4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"list-style-type: decimal; font-weight: bold;\" start=\"2\">\n \t<li>\n<p style=\"margin-bottom: 0;\">Right to Vote<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4939b93 elementor-widget elementor-widget-text-editor\" data-id=\"4939b93\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"font-weight: bold;\">\n \t<li>\n<p style=\"font-weight: normal; margin-bottom: 0;\">With the prior written consent of the primary member, an Associate Member has the right to vote in the society&#8217;s elections. This consent is essential to ensure that the primary member&#8217;s interests are duly represented.<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f25547 elementor-widget elementor-widget-text-editor\" data-id=\"8f25547\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"list-style-type: decimal; font-weight: bold;\" start=\"3\">\n \t<li>\n<p style=\"margin-bottom: 0;\">Right to Contest Elections<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e66704 elementor-widget elementor-widget-text-editor\" data-id=\"6e66704\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"font-weight: bold;\">\n \t<li>\n<p style=\"font-weight: normal; margin-bottom: 0;\">An Associate Member has the right to contest elections to the Committee, again with the prior written consent of the primary member. This allows them to actively participate in the governance of the society.\n<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-31594b1 elementor-widget elementor-widget-text-editor\" data-id=\"31594b1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"list-style-type: decimal; font-weight: bold;\" start=\"4\">\n \t<li>\n<p style=\"margin-bottom: 0;\">Right to Access Information<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93e14ab elementor-widget elementor-widget-text-editor\" data-id=\"93e14ab\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"font-weight: bold;\">\n \t<li>\n<p style=\"font-weight: normal; margin-bottom: 0;\">Associate Members can request copies of any documents mentioned in the Act within forty-five days from the date of payment of such fees at a rate decided by the Registrar. If the society is assisted by the Government, the information must be furnished within thirty days from the date of the request.\n<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eb5a7a4 elementor-widget elementor-widget-text-editor\" data-id=\"eb5a7a4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"list-style-type: decimal; font-weight: bold;\" start=\"5\">\n \t<li>\n<p style=\"margin-bottom: 0;\">Right to Representation<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-313a5ac elementor-widget elementor-widget-text-editor\" data-id=\"313a5ac\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol style=\"font-weight: bold;\">\n \t<li>\n<p style=\"font-weight: normal; margin-bottom: 0;\">In the case of a joint Member, if the person whose name stands first in the share certificate is absent, the Associate Member may have the right to vote, provided they are present and not a minor.\n<\/p>\n<\/li>\n<\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e9a26b elementor-widget elementor-widget-text-editor\" data-id=\"4e9a26b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tIt is important to note that these rights are contingent upon the Associate Member&#8217;s adherence to the society&#8217;s rules and bye-laws, as well as their fulfillment of any duties and responsibilities as outlined in the Act.
